Fatal Hit-and-Run Motorcycle Crash in Osceola County

OSCEOLA COUNTY, Fla. — A 24-year-old Orlando man was killed in a hit-and-run crash while riding a motorcycle on May 19 at around 7:30 p.m., authorities said.

The accident occurred on Monterey Road at KOA Street near Poinciana. The motorcyclist was traveling west on a 2005 Honda motorcycle when a southbound car struck him, Florida Highway Patrol reported. The collision sent the motorcycle into the path of an oncoming SUV, resulting in a second crash.

The motorcyclist was pronounced dead at the scene. The driver of the SUV was uninjured and remained on the scene.

The driver of the car that initially struck the motorcyclist fled. Investigators found what they believe to be a piece of the suspect vehicle, which is thought to be a green 2008-2010 Honda Accord, likely missing a bumper.

Anyone with information about the crash or the vehicle is asked to contact the Florida Highway Patrol at 407-737-2213 or Crimeline at 800-423-TIPS.

What to Do If You or a Loved One is Involved in a Hit-and-Run Accident While Riding a Motorcycle

In Florida, the law mandates that drivers must stop at the scene of any crash that results in property damage, injury, or death. However, despite these stringent legal requirements, the state experienced a staggering 104,273 hit-and-run crashes in 2023 alone. Of these incidents, 871 resulted in serious bodily injury, and 271 tragically ended in death. These numbers highlight a growing concern and the harsh reality faced by victims, especially motorcyclists, who are inherently more vulnerable on the road due to their lack of protection compared to other motorists.

Hit-and-run accidents leave victims in a state of shock and confusion, often facing significant physical, emotional, and financial challenges. The immediate aftermath of such an incident is critical, and knowing the right steps to take can make a substantial difference in recovery and legal outcomes. For motorcyclists, the risks are even higher, and the need for prompt and effective action is paramount.

Florida’s no-fault insurance system does provide a safety net, ensuring that victims can access some level of compensation regardless of fault. However, navigating this system can be daunting, particularly in the chaotic and stressful aftermath of a hit-and-run accident. Understanding how to effectively utilize your insurance coverage and knowing your rights under Florida law are crucial steps toward securing the compensation and support you need.

This article aims to be a comprehensive guide for motorcyclists and their loved ones dealing with the aftermath of a hit-and-run accident. It will walk you through the essential steps to take immediately following the incident, detail how Florida’s insurance laws apply, and underscore the importance of seeking professional legal assistance. Engaging a qualified attorney, such as those at Anthony-Smith Law, can significantly impact your ability to negotiate with insurance companies, secure the maximum possible settlement, or, if necessary, pursue legal action in court.

By understanding the legal landscape and taking informed actions, you can protect your rights and ensure the best possible outcome in a challenging and often overwhelming situation. Remember, you are not alone in this process—expert legal support is just a phone call away at 321-900-HELP (321-900-4357).

Immediate Steps to Take After a Hit-and-Run Accident

Ensure Safety and Seek Medical Attention

  1. Move to Safety: If possible, move yourself and your motorcycle out of traffic to avoid further harm. This will help prevent additional accidents and ensure that you are in a safe location away from oncoming vehicles.
  1. Check for Injuries: Assess your condition and the condition of any passengers for injuries. Even if injuries seem minor, it’s crucial to call 911 immediately for medical assistance. Internal injuries might not be apparent right away, and prompt medical evaluation is essential.
  1. Stay Calm: Try to remain calm and composed. Avoid making any statements about the accident or assigning fault at the scene. Emotional responses can cloud judgment and potentially complicate future legal and insurance processes.

Report the Accident

  1. Contact Law Enforcement: Report the hit-and-run to the police as soon as possible. Provide law enforcement with as many details as you can remember about the incident and the fleeing vehicle, such as the make, model, color, and any distinguishing features.
  1. File a Report: Ensure that an official police report is filed. This report is crucial for your insurance claims and any legal proceedings that may follow. It provides an official account of the incident, which can support your case when dealing with insurance companies or in court.

Gather Evidence

  1. Photograph the Scene: Take clear, comprehensive photos of the accident scene, including your injuries and any damage to your motorcycle. Photographic evidence is invaluable in documenting the extent of the damage and the nature of the accident.
  1. Collect Witness Information: If there are witnesses to the accident, gather their contact information and, if possible, their statements. Witnesses can provide critical third-party accounts of the incident, which can be highly beneficial in both insurance claims and legal matters.
  1. Document Details: Write down everything you remember about the accident as soon as you can. Include details about the make, model, and color of the fleeing vehicle, the direction it was headed, and any other relevant information. These details can help the police in their investigation and support your case.

What You Need to Know About Florida’s No-Fault Insurance System

Florida’s no-fault insurance system is designed to provide quick and straightforward compensation to victims of accidents, regardless of who is at fault. This system includes mandatory Personal Injury Protection (PIP) coverage and optional Uninsured/Underinsured Motorist (UM/UIM) coverage, both of which are crucial in the aftermath of a hit-and-run motorcycle accident.

Personal Injury Protection (PIP)

  • Coverage: PIP coverage in Florida is mandatory for all motorists. It provides essential financial support by covering medical expenses, lost wages, and other damages irrespective of who is at fault in the accident. This means that even if the at-fault driver is unknown or the accident involves a hit-and-run, PIP ensures that you receive immediate financial assistance.
  • Claim Process: To receive PIP benefits, you need to file a claim with your insurance company as soon as possible following the accident. PIP typically covers up to $10,000 in medical expenses. It is crucial to provide all necessary documentation, such as medical records and the police report, to support your claim. Prompt filing is essential to ensure that your medical bills and other expenses are covered without delay.

Uninsured/Underinsured Motorist Coverage (UM/UIM)

  • Importance: UM/UIM coverage is an optional but highly recommended addition to your insurance policy. This coverage is particularly vital in hit-and-run cases where the at-fault driver cannot be identified or in situations where the driver responsible lacks sufficient insurance. UM/UIM ensures that you are not left bearing the financial burden of the accident alone.
  • Benefits: UM/UIM coverage can provide compensation beyond what PIP offers. It covers medical expenses, lost wages, and pain and suffering that exceed the PIP limits. In the case of serious injuries or long-term disability resulting from a hit-and-run accident, UM/UIM can be a crucial source of financial support. This coverage helps bridge the gap and ensures that you receive adequate compensation to cover all related costs, providing a more comprehensive financial safety net.

By understanding and utilizing these insurance coverages, you can secure the financial support needed to recover from a hit-and-run motorcycle accident. It is also beneficial to consult with a qualified attorney to navigate the complexities of insurance claims and maximize your benefits.

What You Need to Know About Filing Insurance Claims after a Hit-and-Run

Filing insurance claims after a hit-and-run motorcycle accident can be a complex and daunting process. Understanding the steps and being well-prepared can help ensure that you receive the compensation you deserve. This section outlines the critical actions you need to take when dealing with your insurance company after such an incident.

Contact Your Insurance Company

  • Report the Accident: Notify your insurer about the hit-and-run incident as soon as possible. Timely reporting is crucial for processing your claim. Ideally, you should have an attorney handle this on your behalf to ensure that all necessary details are communicated accurately and effectively. If you haven’t already, contact an attorney immediately after the accident to assist with this process.
  • Provide Documentation: Submit all necessary documentation to your insurance company. This includes the police report, medical records, and any evidence you collected from the scene, such as photographs and witness statements. Comprehensive documentation strengthens your claim and helps expedite the process.

Cooperate with the Investigation

  • Insurance Adjuster: An insurance adjuster will be assigned to investigate your claim. It is important to cooperate fully and provide all requested information promptly. The adjuster’s role is to verify the details of the accident and assess the extent of the damage and injuries.
  • Medical Examinations: Be prepared to undergo medical examinations as part of the claims process. These examinations are conducted to validate the injuries you sustained in the accident. Ensure that you attend all scheduled appointments and provide thorough and accurate information about your medical condition.
