Elderly Scooter Driver Fatally Struck by SUV

A tragic collision in Orange County claimed the life of a 74-year-old scooter driver on Sunday evening. According to the Florida Highway Patrol, the fatal incident occurred around 7:58 p.m. at the intersection of Town Loop Boulevard and Town Center Boulevard.

Details from the crash report reveal that the elderly man was operating a Jiajue scooter, traveling north on Town Loop Boulevard in the outside lane, while simultaneously, a Honda CR-V was heading east on Town Center Boulevard in the outside lane. As the scooter approached Town Center Boulevard, the driver attempted to make a right turn to head east but inadvertently crossed into the path of the SUV.

The impact occurred when the left front of the scooter collided with the right front of the CR-V. Despite immediate medical attention, the scooter driver was pronounced dead upon arrival at a local hospital, as confirmed by the FHP.

The driver of the SUV, a 44-year-old Kissimmee woman, along with three passengers, sustained minor injuries and were transported for medical evaluation. Presently, the eastbound lanes of Town Center Boulevard and the northbound lanes of Town Loop Boulevard are closed as authorities investigate the circumstances surrounding the tragic incident.

Navigating the Complexities of Insurance Claims After a Deadly Auto Accident in Orlando, FL

Losing a loved one in a car accident is a heart-wrenching experience that leaves families not only grieving but often overwhelmed by the legal and financial aftermath. In Orlando, Florida, understanding the nuances of making an insurance claim under the state’s no-fault laws can be particularly challenging. This blog aims to guide you through the process, highlighting the importance of legal assistance from firms like Anthony-Smith Law.

Understanding Florida’s No-Fault Insurance System and Its Impact on Fatal Accidents

Florida operates under a no-fault insurance system, which means that each driver’s insurance company covers their own medical expenses and lost wages up to the policy limit, regardless of who was at fault. However, in the event of a fatal accident, the situation becomes significantly more complex.

In cases of deadly accidents, the no-fault law still requires the victim’s insurance provider to cover the initial medical bills and certain other expenses. However, when the expenses exceed typical personal injury protection (PIP) limits, or in the event of wrongful death, the surviving family members may seek further compensation through a wrongful death claim against the at-fault driver’s insurance.

Who Is Eligible to File an Insurance Claim After a Deadly Auto Accident?

Typically, the immediate family members of the deceased—such as spouses, children, or parents—are eligible to make an insurance claim following a fatal accident. The claimant can seek compensation for medical expenses incurred before death, funeral and burial costs, loss of the deceased’s expected earnings, and non-economic damages such as loss of companionship and emotional distress.

The specifics of who should file varies based on the family structure and the details of the insurance policies involved. It’s essential to consult with a knowledgeable attorney to ensure that the right parties are filing the claim to optimize the compensation received.

The Critical Role of an Attorney in Filing Your Insurance Claim

Navigating the aftermath of a fatal auto accident involves dealing with complex legal and insurance issues that can be daunting for grieving families. This is where the expertise of a personal injury attorney becomes invaluable.

An attorney can help by:

  • Assessing the Case: An experienced lawyer will evaluate the details of the accident to determine the most effective legal approach.
  • Handling Insurance Companies: Attorneys deal with insurance adjusters, who often aim to minimize the company’s payout. A skilled lawyer ensures that your family’s rights are protected and that you receive the full compensation you deserve.
  • Filing a Wrongful Death Claim: If the accident was caused by another party’s negligence, your attorney could file a wrongful death lawsuit on your behalf, potentially increasing the compensation you might receive substantially.
