Pedestrians Hit-by-A-Car Accidents

According to the National Highway Traffic Safety Administration reports, each year close to 5,000 pedestrians die in motor vehicle related accidents and nearly 76,000 pedestrians in 2012 suffered injuries when hit by a car or truck.  Not having the protection afforded by other vehicles, pedestrian accident victims can suffer minor to major injuries or even death.  The duty of care owed by the pedestrian and driver contributes significantly to these types of accidents.  Both drivers and pedestrians must follow the rules of the road and exercise reasonable care.  Several of the most common factors contributing to driver negligence are:

  • Driver distracted by a car passenger or cell phone
  • Distracted driving by another passenger or a cell phone
  • Speeding
  • Failure to yield the right of way to pedestrians in the crosswalks
  • Disobeying traffic sign or signals
  • Failing to signal while turning
  • Disregarding weather or traffic conditions
  • Driving under the influence (DUI)

Several of the most common factors contributing to pedestrian negligence are:

  • Ignoring the walk signal at an intersection
  • Disrupting the flow of traffic by improper entry into the traffic
  • Failing to use marked crosswalks
  • Darting in front of a vehicle

  • Do not leave the scene of the accident before help arrives
  • Gather names and phone numbers of any witnesses (cell phone cameras are a useful tool as you should always take pictures if possible)
